What I meant by "punishing him would be fruitless" is that, given his (the murderer's) mindset, he is going to break the law regardless. He is not intimidated of being arrested, imprisoned, or potentially executed, like you, I, or any other active, healthy member of a functioning society is.
If one solemnly believes that a prison should do nothing more than house criminals as "punishment" then they are part of the problem - by ignoring it. "Out of sight, out of mind" they say. This is how the Canadian prison system works. American one is even worse, unsurprisingly. Ask any criminology major; the general consensus is that prison does not work.
